Trading crypto-assets peer-to-peer carries significant risk. This disclosure highlights key risks of using the mSamex P2P Platform. It is not exhaustive and forms part of our Terms of Service. Only trade what you can afford to lose, and do your own due diligence.
Crypto-asset prices are highly volatile and can move sharply against you in seconds. The value of what you buy or sell may change before, during or after a Trade. You bear all market risk.
Blockchain transactions are final and irreversible. Once the Escrow Contract releases crypto-assets, no one — including us — can reverse the transfer. Verify every detail (amount, address, payment reference) before you act.
You trade directly with other people. Escrow secures only the crypto leg. The fiat payment happens off-Platform through banks or payment apps, which we do not see or control. A Counterparty may fail to pay, pay late, send a fake or reversible payment, or later cause a payment to be reversed, frozen or charged back by a bank or authority — including after you have released crypto. You are responsible for confirming you have genuinely and irrevocably received payment before releasing.
The Escrow Contract is software and may contain bugs, vulnerabilities or unexpected behaviour. Blockchains can experience congestion, high or volatile gas fees, downtime, forks, reorganisations or attacks. Wallets, RPC/node providers and other tools you use carry their own risks. Any of these can cause delay, loss or failure of a Trade.
You control your own wallet and keys. If you lose your private keys or seed phrase, or they are stolen, your assets may be permanently lost, and we cannot recover them. Phishing, malware and social-engineering attacks are common — protect your credentials.
There may not always be a Counterparty at the price or size you want. Trades may take time to fill or may not fill at all.
Laws affecting crypto-assets and P2P trading vary by jurisdiction and can change. Your activity may be restricted, taxed or prohibited where you are. You are solely responsible for determining the legality of your use and for all taxes and reporting obligations.
Bad actors may attempt to deceive you with fake receipts, impersonation, off-Platform deals, or pressure to release early. Keep all communication and payment within the Platform's escrow process, never release before genuine payment is confirmed, and use the dispute process if something is wrong.
Crypto-assets and any fiat involved are not insured or guaranteed by any deposit-protection scheme, government or by mSamex. There is no compensation fund for losses.
The Platform may be unavailable, modified or discontinued, and access to your Account may be restricted, suspended or terminated under our Terms and AML Policy. Such events may prevent you from transacting through the Platform at a given time.
